Louisiana wrote diminished value into statute. La. R.S. 9:2800.17 provides that when a vehicle is damaged through a third party's negligence without being destroyed, the owner who proves by a preponderance of the evidence that the repaired vehicle's fair market value is less than its pre-damage value "shall be entitled to recover as additional damages an amount equal to the diminution in the value of the vehicle" (capped at pre-damage fair market value).
