Used against claims from every major insurer in North Carolina
What North Carolina law says about your claim.
North Carolina gives DV claimants two rare tools. First, a statutory appraisal procedure: if you and the insurer disagree on diminished value by more than $2,000 or 25% of the vehicle's fair market retail value, each side appoints an appraiser and an umpire's decision binds both (N.C. Gen. Stat. § 20-279.21(d1)). Second, signing a repair release does not bar a diminished value claim you couldn't determine until after repairs: a DV claim asserted within 30 days after repair is deemed promptly asserted (11 N.C. Admin. Code 4.0421(5)). The underlying measure is the difference in fair market value before and after the damage (N.C. Pattern Jury Inst. — Motor Veh. § 106.62).
